Video Production Contract
THIS VIDEO PRODUCTION CONTRACT (“Contract”) is made and effective by clicking on the “Place Order” button, by and between livetorelive.com, (“Producer”) and current user (“Customer”). By clicking on the “Place Order” button, Customer agrees to be bound by these Terms and Conditions, whether or not Customer has read them. Producer may at its sole discretion modify these Terms and Conditions at any time and any modifications shall become effective immediately as posted on this site. By clicking on the “Place Order” button, Customer indicates acceptance of the modified Terms and Conditions.
NOW, THEREFORE, in consideration of the mutual covenants and promises hereinafter set forth, the parties hereto agree as follows:
By entering this contact, Customer is engaging Producer as an independent contractor for creating a video (the “Services”). In consideration of the mutual obligations specified in this Video Production Contract (the “Contract”), the parties, intending to be legally bound hereby, agree to the provisions of this Contract.
Customer hereby agrees to provide Producer sufficient video footage (the “Content”). The Content shall comprise of video that was filmed using the “LIVE TO relive” package or customer’s own equipment purchased with the “reLIVE” package.
Producer hereby agrees to provide one 3-5 minute video, created from the Content provided by the Customer.
Producer reserves the right to deem any content provided by the customer unusable. Unusable is defined as insufficient quantity or quality of content. In the situation the Customers does not provide usable content, the Producer, on behalf livetorelive.com, will return the amount of the Services ($200.00) less processing fees ($30.00) from either the purchase of the “reLIVE” or “LIVE TO reLIVE” packages.
By providing Content for a video production, Customer grants the Producer and livetorelive.com an irrevocable, non-exclusive, fully paid-up, royalty free license, to the content and video including but not limited to all rights to post the video on livetorelive.com and any social media. Content can be used for any promotional items for livetorelive.com.
Privacy
Should Customer wish to keep provided content private, written request shall be provided with the purchase of the “reLIVE” or “LIVE TO reLIVE” packages. Should written request be provided, livetorelive.com will supply a password-protected page for customer to view created video purchased from either the above mentioned packages.
Satisfaction
Should Customer feel the services provided by Producer are not satisfactory, customer may supply written request for refund. Request must clearly convey reasons for lack of satisfaction, order confirmation number, and must be submitted within 7 days of receipt of the provided services.
Livetorelive.com has the final say as to if the services provided are satisfactory. Should the services be determined to not be to the livetorelive.com standards, full refund for the services will be returned to the customer within 30 days of written request.
Breach
Breach by Customer – Producer may terminate the Contract at any time if Producer is unable to perform its duties do in part to Customer’s breach. Producer shall return any Customer content and payment to Customer within 30 days of written notice of termination, minus a $45.00 processing fee.
Breach by Producer – Producer shall notify Customer if it is unable to perform its obligations under this Contract. In the event of such occurrence, Customer shall be entitled to a full refund or shall be credited the Contract amount towards a future purchase at livetorelive.com. Producer’s liability shall not exceed the amount paid by Customer under the Contract.
Limitation of Liability
THE CONTENTS OF THE LIVETORELIVE.COM WEBSITE, AND THE CONTENT PROVIDED BY CUSTOMER ARE “AS IS.” PRODUCER MAKES NO REPRESENTATIONS OR WARRANTIES, WHETHER EXPRESS OR IMPLIED, OF ANY KIND ABOUT THE SERVICES PROVIDED. LIVETORELIVE.COM ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OF THE LIVETORELIVE.COM WEBSITE, FOR ANY FAILURES, DELAYS, OR INTERRUPTIONS IN THE DELIVERY OF ANY CONTENT CONTAINED ON THE LIVETORELIVE.COM WEBSITE, FOR ANY LOSSES OR DAMAGES ARISING FROM THE USE OF THE CONTENT PROVIDED ON THE LIVETORELIVE.COM WEBSITE, OR FOR ANY CONDUCT BY USERS OF THE LIVETORELIVE.COM WEBSITE. TO THE FULL EXTENT PERMISSIBLE BY LAW, PRODUCER DISCLAIMS ALL REPRESENTATIONS ABOUT THE CONTENT DELIVERED. IN ADDITION, PRODUCER DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION ACCESSIBLE VIA THE LIVETORELIVE.COM WEBSITE IS ACCURATE, COMPLETE, OR CURRENT. PRICE AND AVAILABILITY INFORMATION IS SUBJECT TO CHANGE WITHOUT NOTICE. IN NO EVENT SHALL LIVETORELIVE.COM BE LIABLE TO THE CUSTOMER FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF ANY OF THE INFORMATION ON PRODUCERS WEBSITE. .
These Terms and Conditions will supersede any terms and/or conditions Customer includes with any purchase order, regardless of whether Customer signs the purchase order or not. Producer reserves the right to make changes to this site and these Terms and Conditions at any time.
